1. Overview of Terms
1.1 Scope: These terms outline the conditions under which we supply the vehicle specified on the Order Form (“Vehicle”). Please read them carefully before placing your order.
1.2 Importance of Reading: These terms explain who we are, how we provide our products, how you and we can modify or terminate the contract, how to address any issues, and other essential information. If you find any mistakes or have questions, please ask our staff at the dealership where you placed your order.
2. Company Information and Contact
2.1 Who We Are: We are Tracks of Exeter Ltd, trading as Tracks, Tracks Suzuki, or Tracks Suzuki Exeter. Our company is registered in England and Wales (Registration No. 02600554), with our registered office at Alphin Brook Road, Marsh Barton, Exeter, Devon EX2 8QF. Our VAT number is GB 585532907.

3. Contract Formation
3.1 Order Acceptance: By signing the Order Form, you accept these terms and conditions.
3.2 Amendments: Any changes or additions to the contract must be confirmed in writing by an authorized representative. Variations to the Vehicle specifications will amend this contract rather than create a new agreement.
3.3 Order Rejection: If we cannot accept your order, we will notify you without charging for the Vehicle. This may occur if the Vehicle is out of stock, your credit does not meet our requirements, there’s an error in pricing or description, or if we cannot meet your specified delivery date.
3.4 Compliance Information: You must provide necessary information for compliance with money laundering legislation and ensure its accuracy.
4. Product Details
4.1 Visual Representation: Images of the Vehicle are for illustration only. We cannot guarantee that the color displayed matches the actual Vehicle.
4.2 Specification Accuracy: You are responsible for ensuring that any specifications you provide are correct.
4.3 Accessories: Any accessories fitted or supplied by us are covered by the manufacturer’s warranty.
4.4 New Vehicles:
- (a) We will complete all pre-delivery work as specified by the manufacturer, and the Vehicle will carry the manufacturer’s warranty.
- (b) If the manufacturer’s recommended price changes before delivery, we will notify you. You can cancel the contract within 14 days if you disagree with a price increase.
- (c) If the manufacturer ceases production of your ordered Vehicle, we may cancel the contract and refund your deposit.
- (d) If we cannot provide an accessory, we will offer a substitute or remove it from the contract, adjusting the price accordingly.
- (e) Manufacturers may change specifications without notice.
- (f) Delivery mileage for a new Vehicle is generally under 500 miles; for used Vehicles, it will be within 1000 miles of the order form mileage.
4.5 Part Exchange Vehicles: - (a) By signing the Order Form, you confirm ownership of the part-exchange vehicle.
- (b) You must settle any interests in the part-exchange vehicle before transfer to us.
- (c) The vehicle must be delivered in the same condition as assessed prior to the contract.
- (d) The part-exchange price is valid for 14 days.
- (e) The part-exchange vehicle must be delivered by the time you collect your ordered Vehicle.
- (f) Ownership transfers upon delivery of your new Vehicle.
- (g) If you sell your part-exchange vehicle before delivery of the new Vehicle, ownership transfers immediately, and we are not obliged to return it if you do not proceed with the new Vehicle.
- (h) Failure to meet these conditions may result in refusal to accept the part-exchange.
5. Modifying Your Order
If you wish to change your order, please contact us. We will inform you if the change is possible and discuss any adjustments to price, delivery timing, or other implications.
6. Our Right to Modify Orders
6.1 Minor Changes: We may make minor adjustments to comply with legal requirements or to enhance security, which should not affect your use of the Vehicle.
6.2 Significant Changes: For significant changes to the Vehicle or terms, we will notify you. If you disagree, you may terminate the contract and receive a full refund.
7. Delivery of the Vehicle
7.1 Delivery Location: Delivery will occur at the dealership specified in the Order Form unless otherwise agreed.
7.2 Delays: We are not liable for delays caused by events outside our control. If significant delays occur, you may terminate the contract and receive a refund.
7.3 Late Delivery Rights: You can terminate the contract if we miss the delivery deadline, provided you notified us and delivery was essential.
7.4 Cancellation for Late Delivery: If we fail to deliver within 28 days of the estimated date, you may cancel the contract with a seven-day notice period.
7.5 Ownership and Responsibility: The Vehicle remains our property until full payment is received, but you are responsible for loss or damage once you take delivery.
7.6 Required Information: We may need information from you to supply the Vehicle. If not provided, we may end the contract or charge for additional work required.
7.7 Suspension of Supply: We may suspend supply for various reasons, including technical adjustments or events beyond our control.
7.8 Notification of Suspension: We will inform you in advance of any suspension, unless urgent.
8. Your Right to Terminate the Contract
8.1 Termination Before Delivery: You may cancel your order before delivery, but there may be fees.
8.2 Termination for Valid Reasons: You can terminate immediately for reasons like changes to the contract or significant delays.
8.3 Termination Without Valid Reason: If you terminate for reasons not stated, we may retain your deposit.
8.4 Returning Products: If you cancel after delivery, you must return the Vehicle, and we may charge for any loss in value due to your handling.
9. Our Right to Terminate the Contract
9.1 Breach of Contract: We may terminate the contract if you fail to make payments or provide necessary information.
9.2 Compensation for Breach: We will refund payments made, but may retain deposits reflecting our losses.
10. Issues with the Vehicle
10.1 Reporting Problems: Contact us with any questions or complaints about the Vehicle.
10.2 Legal Rights Summary: We are legally obligated to supply conforming products. Your rights include refunds for faulty goods and other protections under the Consumer Rights Act 2015.
10.3 Returning Faulty Products: You must return faulty products to us, and we will cover return costs under certain circumstances.
11. Price and Payment
11.1 Pricing: The Vehicle price (including VAT) is specified in the Order Form. All payments must be made via bank transfer. Credit and debit cards up to £500 only. We do not accept American Express.
11.2 Tax Changes: If tax rates change before delivery, you will pay the current rate unless fully paid prior to the change.
11.3 Pricing Errors: We may terminate the contract and refund you if a pricing error is evident.
11.4 Late Payment Interest: Late payments may incur interest at 3% above the base lending rate.
12. Liability
12.1 Foreseeable Loss: We are liable for foreseeable loss or damage due to contract breaches, but not for unforeseen losses.
12.2 Non-Exclusion of Liability: We do not limit liability for unlawful acts, including negligence or defective products.
12.3 No Business Loss Liability: Our liability is limited to private use; we are not responsible for business-related losses.
13. Use of Personal Information
13.1 Privacy Policy: We will use your personal information as described in our Privacy Policy, available on our website.
14. Additional Terms
14.1 Contract Enforcement: Delays in enforcing the contract do not prevent us from enforcing it later.
14.2 Governing Law: These terms are governed by English law, with proceedings in relevant courts.
14.3 Dispute Resolution: We adhere to the Motor Industry Code of Practice and recommend contacting Motor Codes for unresolved disputes. Their decisions are binding.
